General information and product description

These General Terms and Conditions of Business (as amended) shall apply to business relationships of any kind between UltraViola Audio Lpc. and the customer. Customers may be businesses or consumers. A consumer shall mean any natural person who concludes a legal transaction for purposes that can be primarily attributed neither to a trade nor a profession (8:1. §(1) Hungarian Civil Code). A business shall mean a natural or legal person or a partnership with legal capacity which, in concluding a legal transaction, is acting in the exercise of its trade or profession.

The items presented in our webshop are the object of the contract between the seller and the client. The detailed properties and description of each item can be find on it's own page. Please read these informations carefully so that you purchase only the items you actually needed. In specific cases, please contact us with questions. Some items can have compatibility problems or hidden dangers with them. In this case, reading the description might prove useful. Some images are illustrations only. The gross price is always presented next to the image.

The product display in the online store does not constitute a legally binding offer; instead it is merely a non-binding online catalogue of the range of products available. By clicking ‘Buy’, the customer makes a legally binding commitment to purchase the goods in the shopping basket. The customer shall receive an order confirmation immediately after the order has been submitted. The sales contract shall only enter into effect upon receipt of our separate order confirmation. The contract is stored, and the order data and General Terms and Conditions are sent to the customer by email. Customers can
view all of their previous orders by logging into the customer service pages of the website.

The contractual language is English.

The ordered items will be transported to the client. UltraViola Audio Lpc. does not keep an item stock of all products. These are brought to us after an order.

Pricing

All prices include VAT (where applicable) at the current rates. We reserve the right to express the price exclusive of VAT, but we shall show VAT separately and include it in the total price. If the customer gives a valid EU VAT number during registration and logs in, the site shows only the prices excluding VAT.

Where we charge separately for packing, carriage and insurance and other relevant charges, the appropriate rates are set out in our specified pricing structure shown elsewhere on this Website.

EU VAT Registered Customers

If the customer is based in the European Union * and holds a valid EU VAT Number, we can zero-rate the transaction, in case he/she gives the valid number during the registration or when updating his/her account. In this case, when logged in, the site shows only the prices excluding VAT.

If the customer is not registered, after choosing 'Company' as the type of customer, he/she can include the VAT number in the ‘VAT’ field of billing informations. Once this number has been verified, the VAT will be removed from the order total by us, and the customer will get the price zero-rated of VAT.

Please note, that both the invoice adress and the delivery adress - including valid EU VAT Numbers - need to be from an EU country which does not make an exception because of domestic customers *.

* - Customers from Hungary make an exception, because they are considered domestic customers.

Shipping

UltraViola offers free shipping inside the EU on orders above net €200. For countries outside the EU the calculated shipping cost is seen at the check-out.

UltraViola for the present primarily aims to serve european customers. If the customer would like shipping to a country outside of Europe, he/she has to contact UltraViola via email before making an order, and UltraViola will calculate the exact shipping cost for him/her.

The contract, how to make an order

The Client, by making an order on the webshop, becomes an UltraViola Audio Lpc. client. The order can be considered final after the client receives the confirmation of his order.

The first step for placing an order is to put the required items into the 'Cart' on the top of the page. This will show the item quantity and price. As soon as the client finished adding the products, he/she can press the 'Proceed to Checkout' button from the cart to begin the final part of the order process. If he/she has not logged in yet, he/she can do so here, or continue as a guest. Client is identified by his/her unique email-address. Here there is the possibility to modify the 'billing' and 'shipping' data, item quantity and payment method and to confirm the shipping method. Alternatively some items can be removed from the order. Paying is possible either by credit/debit card, via Barion, or by wire transfer using the banking details as followings:

Barion Payment Inc. is an Electronic Money issuers, licensed by the Central Bank of Hungary, based on the Electronic Money EU Directive (2009/110/EC; License id: H-EN-I-1064/2013). The credit card data given by the Client is not forwarded to UltraViola Audio Lpc. by Barion.

Barion currently accepts the following credit cards: Amex, Visa, Mastercard, Maestro, Visa Electron, American Express.

There is no possibility to make any modifications by the client after the order is launched. To launch the order, after verification, the 'Finish' button needs to be pressed. Automatic confirmation email will follow.

We may refuse to accept an order:

1. where goods are not available;
2. where we cannot obtain authorisation for your payment;
3. if there has been a pricing or product description error; or
4. if you do not meet any eligibility criteria set out in our terms and
   conditions

Client data security

The data provided by the client, that are required for identification, are handled securely and are used only to create the orders. The electronic services of UltraViola Audio Lpc. can be attained via a unique password. The password identifies the Client, it's use proves that the order is made by the Client. The order is recorded by our computer network, and sends out an automated confirmation. The Client assumes all responsibility for the handling of the password ad does not disclose it to a third party. UltraViola Audio Lpc. does not assume responsibility for damages caused by the illegal use of the password either by the client or the third party or by any incorrect data given during the registration.

The contract and the language of the contract is English. The contract, as stated above, is considered a written contract. This will be registered by UltraViola Audio Lpc. and will be accessible later. For more information about data security, see our Privacy Policy.

Delivery, payment and completion conditions

See delivery charges in 'Delivery Information' menu. UltraViola Audio Lpc. does not assume responsibility for any loss or damage occuring due to incorrect information given by the customer. In this case the customer has to pay the occurent additional charges.

There is no additional fee calculated for credit card users.

Warranty information

The 1959, IV. law from the Civil Law states that in Hungary, all newly bought items have 2 year warranty assured (robust items have 3), in case that a contract is created. Based on the 151/2003 Government statement, the listed durable items are subject to a 1 year warranty, concerning UltraViola Audio Lpc. In some cases the manufacturer can offer a longer warranty period, this time period is supported by UltraViola Audio Lpc. The warranty, in case it is more then 1 year, has a longer description stated on the products warranty slip. If asked for we will provide the information ourselves.

The Warranty conditions are contained in the Civil law's, 49/2003th GKM statement. UltraViola Audio Lpc. is obliged to offer warranty services, in case the sold item, at the delivery time, does not comply with the stated properties stated in the Law and properties described in the contract. The condition of the warranty process is that if the parts do no agree about the malfunction's origin, the Client is obliged to provide proof about it (professional expertise). The fulfillment has to be defended for in the next 6 months, (that the found malfunction was present at the delivery).In this period the proving is UltraViola Audio Lpc.'s obligation.

If the malfunction was known to the Client at the moment of the making of the contract, or the Client should have known about it, UltraViola Audio Lpc. is free from warranty obligations. The conditions of the Warranty, as mentioned in the 151/2003. Gov. statement, is found in the Civil law and the 49/2003. GKM statement. To take advantage of the warranty the warranty paper is mandatory. It is important that in case of warranty, the obliged part is not free from the obligation until it proves that the malfunction is not.

Defects or any other damage caused by negligent or improper treatment of the goods, improper installation, the use of unsuitable accessories or changes made to the original parts by the customer or a third party not commissioned by UltraViola Audio Lpc. are not covered by the warranty.Signs of wear and tear from normal use are also excluded from the warranty. If the customer accepts the goods or the object of the order despite being aware of a defect, he/she shall only be entitled to assert warranty claims to the extent described below if he/she has expressly reserved the right hereto in writing immediately after receiving the goods. Warranty claims on the grounds of transportation damage may only be asserted by the customer if the obligation to inspect and report has been fulfilled. This does not apply if the customer is a consumer.

Enforcement

We ask our customers that if the ordered items arrive, before they are handed over to be checked for completion, conformity and transport damages. Otherwise, in case of home delivery, it is hard to prove damages or missing items. In case of product quality issues, it will be handled according to the 49/2003. GKM statement.

The warranty claims can be attained with the purchase documents. UltraViola Audio Lpc. is obliged to take note of the claim and malfunction. UltraViola Audio Lpc. will try to resolve the warranty claim in a 15 day period. For warranty claims please contact us at the above stated e-mail address.

Statutory right of withdrawal

If the customer is a consumer, he/she shall be entitled to withdraw from this Contract within fourteen (14) days without giving any reason for doing so. The deadline for withdrawal shall be fourteen (14) days from the date on which the customer or a third party appointed by the customer, who is not the carrier, takes possession of the final goods delivered.

You need JavaScript enabled to view it.) of his/her decision to withdraw from this Contract in a clear declaration (e.g. by sending a letter by mail, fax or email). The withdrawal deadline shall be deemed to be met if the customer sends the communication concerning the exercise of the right of withdrawal before the expiry of the deadline.

Please note, that the customer can not exercise the statutory right of withdrawal, if he/she has made the order as a company.

Consequences of withdrawal

The costs of returning goods to UltraViola Audio Lpc. shall be borne by the customer, in all circumstances without exception, unless UltraViola Audio Lpc. has supplied the consumer with a faulty item he/she wishes to exchange. Items must be packed suitably and insured for full loss in the event of a delivery problem. UltraViola Lpc. will not be responsible for lost or damaged returned goods. Lost or damaged goods may effect the level of refund on equipment. The original postage and packaging costs will not be refunded under any circumstances unless agreed with UltraViola Lpc. Upon receipt of the goods, to UltraViola Audio Lpc. return address, and with prior arrangement, UltraViola Audio Lpc. will give the customer a full refund of the amount paid or an exchange credit as required and agreed

Exclusions from the statutory right of withdrawal

The statutory right of withdrawal shall not apply in the following cases:

• Delivery of goods which are not prefabricated and have been manufactured on the basis of a personal choice or according to customer specifications, or of goods which have clearly been tailored to the customer’s personal requirements.
• Delivery of sealed goods which are not suitable to be returned for reasons relating to health protection or hygiene if their seal has been removed after delivery.
• Delivery of audio or video recordings or computer software in sealed packaging if the seal has been removed after delivery.
• Delivery of newspapers, journals or magazines, excluding subscription contracts.

While we endeavour to ensure that this Website is normally available 24 hours a day, we will not be liable if for any reason this Website is unavailable at any time or for any period.

Access to this Website may be suspended temporarily and without notice in the case of system failure, maintenance or repair or for reasons beyond our control.
